Thank you for choosing MedScoutr ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Overview of the Service
MedScoutr provides a service that leverages both human agents and artificial intelligence (AI) to assist individuals in locating hard-to-find medications. We help connect you with pharmacies or suppliers that may have the medication you are seeking. Our Service is intended to be an informational resource and is not a substitute for professional medical advice, diagnosis, or treatment.
2. Account Registration and Security
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, complete, and current information during the registration process and to update such information as needed. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Use of the Service
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You are prohibited from:
- Using the Service in any way that violates any applicable federal, state, local, or international law or regulation.
- Using the Service to exploit, harm, or attempt to exploit or harm minors in any way.
- Impersonating or attempting to impersonate the Company, a Company employee, another user, or any other person or entity.
- Engaging in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, as determined by us, may harm the Company or users of the Service or expose them to liability.
5. Privacy Policy

6. No Medical Advice
The information provided through the Service is for general informational purposes only and is not intended as, nor should it be considered, medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or medication. The Service does not create a doctor-patient relationship between you and MedScoutr or any of our agents.
7. Medication Liability
Company does not assume any liability related to the patient's use of medications. Patients are solely responsible for their medications, and Company shall not be held responsible for any consequences arising from the use or misuse of medications.
8. Prescription Search Guarantee
Company does not guarantee that we will be able to find your prescription. Patients will be charged immediately when they sign up, but searches may be refunded upon request if Company does not locate their medications within 5 business days of signing up.
9. Limitation of Liability
To the fullest extent permitted by applicable law, the Company, its affiliates, and their respective officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the Service;
- Any unauthorized access to or use of our servers and/or any personal information stored therein;
- Any interruption or cessation of transmission to or from the Service;
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.
10. Indemnification
You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
11. Modifications to the Service and Terms
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also revise these Terms from time to time. If we make material changes to these Terms, we will notify you by email or by posting a notice on the Service prior to the effective date of the changes. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
